TRIGGERMIKE’S FIREARMS TRAINING, LLC FIREARMS TRAINING, RELEASE, WAIVER, INDEMNIFICATION AND ASSUMPTION OF RISK AGREEMENT 
I, _________________________________, (the “Student”) hereby agree to all of the following in consideration of being permitted to attend a firearms training course to learn the proper and safe use of using and carrying firearms: 
1. Student is voluntarily participating in a firearms training course offered by TriggerMike’s Firearms Training, LLC and Michael S. Dunlap, all employees of either, agents or assistants (collectively, the “Instructor”). Student understands the risks and hazards involved with the use and discharge of firearms. Student recognizes that serious and/or life-threatening injuries can occur while carrying or using a firearm or participating in the class offered by Instructor. 
2. Student represents to Instructor the following: (a) Student is physically fit and has no medical, psychological or any other condition which would prevent Student from participating in handling, possessing or using a firearm; (b) Student is not prohibited by federal or state law to possess, use or own a firearm, is not a felon, an illegal immigrant, under the age of 21 (other than an active member of the Armed Forces of the United States), is not currently charged with a crime or has an injunction or protection from abuse order of court issued against Student; (c) Student is not a fugitive from justice, has never renounced Student’s citizenship, or a member of a subversive or terrorist organization; and (d) Student has not been previously denied a license to carry a conceal carry permit or been failed to pass the NICS or PICS background check when applying to purchase a firearm. 
3. Student agrees that if Instructor believes that Student is or will be involved in criminal activity of any type, Instructor will refuse to permit Student to participate in the firearms training course. Further, Student agrees that if Instructor believes that Student is or will be unsafe or dangerous, with or without a firearm, Instructor will refuse to permit Student to participate in the firearms training course. 
4. Student realizes that injury or liability may arise from negligence or carelessness of other students taking the firearms training course offered by Instructor or by Instructor and agrees that those persons and Instructor are being released from all liability except for intentional or grossly negligent conduct. 
5. Student agrees to assume full and complete responsibility for any and all risks, injuries or damages, known or unknown, which Student may incur as a result of participating in the firearms training course offered by Instructor. 
6. Student, for himself or herself, his or her heirs, executors, administrators, successors or assigns, knowingly, voluntarily, and expressly waive, release, discharge, hold harmless, promise to indemnify and defend Instructor from any and all bodily injuries (including the death of Student) or damage to property of whatever kind and nature that Student may sustain as a result of participating in the firearms training course offered by Instructor, or of direct or indirect use of the instruction of the firearms training course, including those taking place outside of the firearms training course no matter when or where such bodily injuries or damage to property occur. Student further understands that this type of training involves the risk of suffering minor injuries such as bruises and lacerations and that this Agreement applies to those injuries as well. 
7. Student agrees that Student will abide by and will follow all range rules and procedures and will immediately follow any other rules or commands of issued by the Instructor. 
8. Student acknowledges and agrees that Student has read and understands this Agreement and its terms and conditions and is executing this Agreement voluntarily and with full understanding of its terms. 
9. Student understands that photographs and/or videos may be taken during the firearms training course to be used by Instructor for advertising purposes. Instructor will obtain the consent of Student before such photographs or video will be used by Instructor. Under no circumstances will Instructor use Student’s name unless written permission is given by Student. 
10. This Agreement is governed by laws of the Commonwealth of Pennsylvania without regard for its conflict of law provisions. Student agrees that venue shall always be in the Court of Common Pleas of Butler County, Pennsylvania.
